PLANS for a 24-hour petrol station in Radstock have been deemed lawful by Bath and North East Somerset Council.

Motor Fuel Group Ltd applied for a Certificate of Lawful Development to the council on May 1 regarding a proposal to have Elm Tree Filling Station open on a 24-hour basis.

The petrol filling station is located on the A367 Wells Road, between the junctions at Inner Elm Terrace and Tanner Close.

The applicant confirmed that planning permission existed for the land to be used as a petrol station, without any restrictions regarding opening times.

Council planners agreed and confirmed on Wednesday, June 25, that the application would be passed — noting that 24-hour use would not breach the Town and County Planning Act 1990.

In its report, council planners said: “A review of planning history has revealed a condition which specifically limits the time for the use of the car wash and jet wash facilities.

“There is however no condition which limits the times of use for the petrol filling station. It is therefore considered that the times of use of the petrol filling station is not controlled by planning condition.”
